Enforcement Rules of the Employment Insurance Act, Made pursuant to Article 43 of Employment Insurance Law.
Contains 26 articles which implement different aspects of the Law. China – Seguridad social – Ley. Revises scheme providing for protection of entitlement of employees and others to compensation for employment-related injury. Provides for relief payments to eligible persons in relation to damages for employment-related injury.
Increases membership of Board. Revises procedures for filing of applications which may affect Fund. Requires Board to be notified of proceedings which may affect Fund. Empowers Board to take part in legal proceedings in order to protect Fund. Reduces amount of interest payable on payments from Fund. Requires employers who have failed to take out relevant policies of insurance to pay surcharge to Board.
Employment Insurance Act, Establishes rules to govern employer contributions to occupational retirement schemes. Provides for financial penalties when an employer fails to make the appropriate “contribution requirements”.
Employees’ Compensation Amendment No. Amends Employees’ Compensation Ordinance. Makes provision for compensation in fatal cases, determination of compensation by commissioner, persons entitled to compensation, distribution of compensation, accident compensation, report of injury or death by employer, determination of claims in respect of minor injuries, liability in case of employees employed by sub-contractors, remedies against both employer and third party, application to persons employed on ships, compensation in case of occupational disease, compulsory insurance against employer’s liability, and several related matters.
Amends Mandatory Provident Fund Schemes General Regulations with regard to the notion of a substantial financial institution, adequate insurance, capital adequacy requirements, non-refusal of scheme applicants, investment management, and some related matters.

Unemployment Insurance Regulations No. Regulates matters related to unemployment insurance. Unemployment insurance shall be funded by employee premiums and employer contributions.
Regulates unemployment benefits, administration of funds, and sanctions in cases of fraud. Provides for the standardization of collecting social insurance premiums. Defines, inter alia, the mission and principles of the medical insurance system reforms, the scope of coverage, the contribution method, and provides for the establishment of a mechanism for the administration and supervision of the basic medical insurance funds.
Comprehensive regulations concerning provident fund schemes. Governs registration of schemes, administration of schemes, duties and responsibilities of trustees, audit and financial control, membership and contributions, and payment of benefits.
Occupational Deafness Compensation Ordinance No. Amends provisions regarding entitlement to compensation, hearing tests and medical examinations, refusal of application, and definition of noisy occupations. Substitutes Schedule 4 which determines percentage of permanent incapacity by reference to noise-induced deafness.
Also amends provisions of the Insurance Companies Ordinance Cap.

Employees’ Compensation Amendment Regulation L. Consequential upon the amendment of the Employees’ Compensation Ordinance Cap. This resolution increases the levels of compensation payable by an employer under the Employees’ Compensation Ordinance in respect of death or permanent total incapacity caused to his employee by accident arising out of and in the course of employment.
This Ordinance makes provisions regarding the pension rights and benefits of certain officers transferred from Government service to service under the Hospital Authority. Seeks to promote reform on the local level and to implement China’s ten-year economic plan and eigth five-year plan. Introduces a three-tier pension scheme and governs the payment of contributions by state enterprises and individual workers. Employees Compensation Assistance Ordinance No. This Ordinance provides for the protection of the entitlement of employees and others to compensation or damages for employment-related injury, for the protection of employers against default under policies of insurance in respect of their liability for such compensation or damages, and for the establishment of a board and a fund for those purposes.
